Today virtually all liberal democracies protect, in formal legal documents as well as in actual practice, both freedom of speech and freedom of the press. The peculiar history and culture of each nation is very important in order to understand different approaches to similar problems and to build a cross-cultural normative critique. This doctoral thesis is mainly concerned with the US approach to classical freedom of speech issues, such as advocacy to commit an offence: the first part of the work aims to describe the most influential pronounces of the US Supreme Court in this field; the second part is concerned with the definition of the constitutional core of democratic speech.

Institutional territories, social spaces: some notes on the sideto a political geography of administrative divisionsWithin the borders of the national States the effective exercise of power is modulated through a plurality of territorial divisions that represent, at the same time, the architecture of the institutional system and the intermediate bodies of the centre/periphery relations. These relationships gave rise to multiple centres of political government that are grafted into the game of scales, with variable geometries, of local territories, no longer classifiable in a binary opposition, affirmed between the age of Enlightenment and the first half of the Twentieth century. The analysis of this interwoven aspects (social, institutional, territorial) in which citizenship horizons coagulate, the political geography of institutional spaces for the government of the territory can unleash all its heuristic potential, revealing profiles partly unexplored for the extent of their social grip.The essay aims to underline the preeminent political nature of territorial orders,of the processes that govern the construction of the institutional mosaic and the design of the different boundaries. It critically reconstructs the state of the art of the themes – placed at the confluence of various knowledge – put to work in the research dedicated to the relationships between spatiality/statehood/administrative boundaries/ citizenship, starting from the studies of political-administrative geography. It then identifies the main methodological acquisitions and the stimuli coming from the advances produced in different disciplinary fronts. Among the many solicitations emerges the shared opinion on the opportunity of a critical genealogy of the thought patterns of modernity, relativizing many of the categories on which we have built the idea of the modern territorial State and the forms with which it has been representedover time.
Il rapporto fra territorio e amministrazioni pubbliche, da tempo, è oggetto di un dibattito internazionale sempre più intenso, stimolato dalle strategie neoliberiste che hanno riconfigurato la statualità contemporanea. In Italia, la questione della revisione delle maglie amministrative si è imposta all'attenzione del discorso pubblico sulla scorta sia dei tentativi di riforme istituzionali abbozzate negli ultimi vent'anni, sia dei processi di rescaling a lungo incoraggiati dall'Unione europea. L'attuale crisi delle relazioni geopolitiche mondiali e l'impasse dell'UE rischiano, tuttavia, di consegnare questo tema alla mera retorica politica. Il contributo affronta il caso della Città metropolitana di Napoli e del suo controverso processo di attuazione, inquadrando le principali criticità che rendono manifesti i limiti della legge Delrio. Al contempo, propone di ripensare criticamente la pluralità di approcci espressi dal dibattito italiano sui mutamenti del mosaico delle circoscrizioni politico amministrative.
